Welcome to MT SWIFT ("we," "our," or "us"). By accessing or using our Banking-as-a-Service (BaaS) platform at mtswift.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

MT SWIFT provides a Banking-as-a-Service platform that enables businesses to integrate banking features into their applications. Our services are powered by Unit.co, a licensed banking-as-a-service provider. Banking services are provided by Unit's partner banks.

2.1 Services Include:

  • Account creation and management
  • Payment processing (ACH, Wire, Checks)
  • Card issuance and management
  • Transaction monitoring and reporting
  • API access for integration
  • Compliance and KYC/AML verification services

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using banking services under applicable laws
  • Provide accurate and complete information during registration
  • Comply with all applicable laws and regulations

4. Account Registration and Security

4.1 Account Creation

To access certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4.2 Identity Verification

We are required by law to verify your identity. You agree to provide all information and documentation necessary for identity verification, including but not limited to:

  • Government-issued identification
  • Social Security Number or Tax Identification Number
  • Proof of address
  • Business documentation (for business accounts)

5. Acceptable Use Policy

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law
  • To engage in any fraudulent, illegal, or unauthorized activities
  • To transmit any material that is defamatory, obscene, or offensive

  • To interfere with or disrupt the Service or servers
  • To attempt to gain unauthorized access to any portion of the Service

5.2 Prohibited Activities

The following activities are strictly prohibited:

  • Money laundering or terrorist financing
  • Fraud or identity theft
  • Sale of illegal goods or services
  • Gambling or gaming (except where explicitly permitted)
  • Adult content or services
  • Cryptocurrency exchanges (unless pre-approved)
  • Any activity involving sanctioned countries or individuals

6. Fees and Payment Terms

6.1 Service Fees

Certain features of our Service may require payment of fees. All fees are described in our pricing documentation and are subject to change with 30 days' notice.

6.2 Payment Processing

You authorize us to charge your designated payment method for all fees incurred. All fees are non-refundable unless otherwise stated.

6.3 Transaction Limits

We may impose transaction limits on your account based on various factors including verification status, transaction history, and risk assessment.

7. Banking Services and Partner Banks

Banking services are provided by our partner banks through Unit.co. Deposits are FDIC insured up to applicable limits when placed at FDIC-insured banks. Additional terms and conditions from our partner banks may apply.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Intellectual Property Rights

The Service and its entire contents, features, and functionality are owned by MT SWIFT and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MT SWIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify, defend, and hold harmless MT SWIFT, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting our support team. You remain responsible for all fees incurred prior to termination.

13.2 Termination by Us

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Failure to provide required documentation
  • Extended inactivity
  • Risk management purposes

14. Dispute Resolution and Arbitration

14.1 Informal Resolution

In the event of any dispute, you agree to first contact us to attempt to resolve the dispute informally.

14.2 Binding Arbitration

If the dispute cannot be resolved informally, any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and MT SWIFT individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

18. Severability
